Terms of Service
These terms cover how you use NestWise, what we promise to do, what we do not do, and how disputes are handled. The most important line, up front: NestWise is a tools + information service. It is not financial advice.
NestWise shows you estimates against published Australian government rates (ATO, Services Australia, DSS). It does not tell you what to do with your money, it does not recommend financial products, and it is not a substitute for personal advice from a qualified professional. We hold no Australian Financial Services Licence (AFSL) and we do not intend to. Any figure NestWise displays should be verified with the relevant government department before you act on it.
1. Who we are
NestWise is operated by Adelante Technologies Pty Ltd (ACN 678 163 490 / ABN 19 678 163 490), an Australian proprietary limited company. Registered office: Sydney, NSW, Australia. Contact: hello@nestwise.net.au.
In these terms, "NestWise", "we", "us" and "our" mean Adelante Technologies Pty Ltd. "You" and "your" mean the person who signs up for or uses the service.
2. Accepting these terms
By creating a NestWise account, signing in, or using any part of the service (including the free calculators, guides, and marketing pages when you are signed in), you agree to be bound by these terms and by the linked Privacy & Data Safety policy at /privacy.
If you do not agree, do not use the service. Signing up on behalf of a household means you are agreeing on your own behalf and confirming that any partner or family member whose data you enter has been informed.
3. Eligibility
You must be at least 18 years old and ordinarily resident in Australia (or dealing with Australian household finances) to hold a NestWise account. NestWise is designed around Australian government payments, tax, super, and childcare rules — most of what we do will not make sense outside that context.
One account per person. You are responsible for keeping your email address current and your password secret. Tell us immediately at hello@nestwise.net.au if you suspect unauthorised access.
4. What NestWise does
NestWise is a family finance and admin tool. It:
- Calculates estimates of Australian government entitlements (Family Tax Benefit, Child Care Subsidy, Parental Leave Pay, Rent Assistance, Kindy fee relief, sport vouchers, Age Pension and others) using rates published by Services Australia, DSS, and the ATO; - Tracks recurring bills, income, super, investments, cash, and savings goals you enter; - Ingests bills and letters you forward to a private NestWise email address (Cloudflare Email Worker + our own ingestion API); - Provides guides on Australian family finance topics, updated as gov rates change.
NestWise does NOT:
- Give personal financial advice, tax advice, or credit advice; - Recommend specific products (super funds, banks, insurers, brokers, financial planners); - Move money on your behalf, act as a payment processor, or hold custody of funds; - Guarantee that any government payment or entitlement will actually be paid to you — that decision rests with Services Australia, the ATO, or the relevant body.
5. Not financial advice — the important part
NestWise is a general information and tools service. Every dollar figure, percentage, or eligibility indication we display is an estimate based on the profile information you have entered and the government rates published at the time of calculation. Rates change at every indexation date (1 July, 20 March, 20 September and other statutory dates); rules change more often than that.
We do not know your full circumstances. We do not know about payments, offsets, exemptions or debts you have not entered. We do not verify that the information you have entered is complete or correct.
Before making any decision that depends on a NestWise figure — including but not limited to: claiming a Centrelink payment, changing your work hours, changing your childcare arrangements, salary sacrificing to super, making a lump sum payment, submitting a tax return, or signing a financial product — verify the figure directly with Services Australia (via myGov), the ATO (via myTax or your tax agent), your super fund, or a qualified professional. Where the decision is material, get personal advice from an appropriately licensed adviser.
We do not hold and are not applying for an Australian Financial Services Licence (AFSL). NestWise is deliberately designed to stay within the "general information and tools" exemption to the licensing regime under the Corporations Act 2001 (Cth). Nothing in the service should be read as a recommendation, opinion, or statement of opinion about a financial product.
6. Subscription plans and billing
NestWise offers a free tier and one or more paid subscription tiers. Current pricing is published on the /pricing page and inside the app. Prices are in Australian dollars, GST-inclusive where applicable.
Paid subscriptions are billed by Stripe on the schedule you selected when you signed up (typically monthly or annually). Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. Cancelling stops future renewals; it does not refund the current billing period unless section 7 applies.
We may change our prices with at least 30 days notice by email to the address on your account. Continuing your subscription after a price change takes effect confirms your acceptance of the new price. If you do not accept, cancel before the effective date and no further charges will be made.
Payment card and billing data is handled by Stripe (PCI-DSS Level 1 certified). NestWise never sees or stores your full card number.
7. Refunds and cancellation
You can cancel your subscription at any time from your account settings or by emailing hello@nestwise.net.au. Cancellation takes effect at the end of the current billing period; you retain paid-tier access until then.
Cooling-off period: if you subscribe to a NEW paid plan and are unsatisfied, you may request a full refund within 14 days of the first charge for that plan, provided you have not made substantial use of the paid features (as a rough guide: more than 30 sessions or more than 20 distinct paid-only features opened). Refunds are made to the original payment method within 10 business days.
Australian Consumer Law: nothing in these terms limits your rights under the Australian Consumer Law (ACL). Consumer guarantees under the ACL cannot be excluded. If NestWise fails to meet a consumer guarantee, you may be entitled to a refund, replacement, or compensation for reasonably foreseeable loss or damage, in addition to (and independent of) our cooling-off refund policy above.
Annual plans: if you cancel an annual plan mid-year outside the 14-day cooling-off window, we will refund the unused portion on a pro-rata basis less a $5 administrative fee, at our reasonable discretion.
8. Acceptable use
You may use NestWise for your own personal or household finance needs. You may not:
- Use the service to provide financial advice to third parties, or resell / redistribute any NestWise content or output as your own product; - Reverse-engineer, decompile, scrape, or attempt to derive the source code of any part of the service (except to the extent permitted by law); - Automate access with bots, crawlers, or headless browsers (other than search-engine indexing of public pages); - Upload content that is illegal, defamatory, infringes another person's rights, or contains malware; - Impersonate another person, or misrepresent your affiliation with any person, organisation or authority; - Interfere with the security or integrity of the service (rate-limit evasion, RLS probing, session hijacking attempts, etc); - Use the inbox forwarding address to receive material that has not been sent to you legitimately, or to relay unsolicited mail.
We may suspend or terminate access for breach without prior notice where the breach is serious or ongoing.
9. Your content and your data
You own the household data you enter into NestWise (income, kids, bills, goals, forwarded emails, notes, uploaded documents). You grant NestWise a limited licence to store, process, transmit and display that data solely to operate the service for you.
We do not sell your data. We do not use your data to train third-party AI models. We do not share your data with government, insurers, marketers, or any third party except the subprocessors listed in the Privacy policy (Supabase for database, Stripe for payments, Resend for outbound email, Vercel for hosting, Anthropic for the in-app AI assistant, Cloudflare Email Worker for inbound-email routing, and — when live — Wych Open Banking for consented bank-data connection).
You can export or delete your data at any time by emailing hello@nestwise.net.au. Deletion is completed within 7 business days.
10. Third-party services
Some features rely on independent third-party services listed in the Privacy policy. Each has its own terms and privacy practices, which apply when you use those integrations. NestWise is not responsible for third-party services' availability, terms, or content.
Bank-data connection (Wych Open Banking, when enabled): connecting your bank account to NestWise is optional, consent-based, and governed by additional Consumer Data Right (CDR) terms that will be presented at the point of consent. You may withdraw consent at any time; withdrawal disconnects the data feed but does not delete data already shared.
11. Intellectual property
NestWise, the NestWise logo, the visual design of the app, the tagline "Less in your head, more in your day", the guides published at /guides, and every underlying calculator, rate library, and content asset are owned by Adelante Technologies Pty Ltd or its licensors, and are protected by Australian and international intellectual property law.
You may quote short excerpts from a NestWise guide for personal reference or public discussion, provided you attribute the quote to NestWise and link to the guide URL. Systematic reproduction of guides, tools, or output is not permitted without written permission.
Feedback you send us (via hello@nestwise.net.au or the in-app feedback surfaces) may be used freely by NestWise to improve the service, without payment or attribution.
12. Accuracy and estimates
We make reasonable efforts to keep every rate, formula, and calculation aligned with current published Australian government sources. Government rates are re-verified against ato.gov.au, servicesaustralia.gov.au and dss.gov.au at every scheduled indexation date, and regression-tested across representative household scenarios.
Despite this, NestWise may from time to time contain errors, out-of-date figures, or gaps in coverage. We do not warrant that the service is error-free or continuously available. Where you find a figure that does not match the government source, please email hello@nestwise.net.au — we fix rate errors as a priority and log every rate change with its source.
You accept that reliance on any NestWise figure is at your own risk and that you must verify material figures independently before acting on them.
13. Limitation of liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law rights preserved in section 7:
- NestWise's total aggregate liability to you for any claim arising out of or in connection with the service (whether in contract, tort, statute, or otherwise) is limited to the amount you have paid us in subscription fees in the 12 months immediately preceding the claim; - We are not liable for any indirect, consequential, incidental, special, or punitive loss, including loss of profits, loss of savings, loss of expected government payment, loss of tax refund, loss of business opportunity, loss of goodwill, or loss of data; - We are not liable for any loss caused by your failure to verify a NestWise figure with the relevant government source before acting on it, or for any loss caused by inaccurate or incomplete information you entered into NestWise.
None of the above limits or excludes any right you have under the Australian Consumer Law that cannot be limited or excluded.
14. Indemnity
You agree to indemnify NestWise, its directors, employees, and agents against any claim, loss, damage, cost or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the service, or content you submit that infringes another person's rights or breaches applicable law.
15. Complaints and dispute resolution
If you are unhappy with any aspect of the service or believe we have breached these terms:
Step 1 — talk to us directly. Email hello@nestwise.net.au with the subject line "Complaint". Include your account email, a plain description of the issue, and what outcome you are seeking. We will acknowledge within 2 business days and aim to resolve within 15 business days.
Step 2 — external options. If we cannot resolve the complaint together:
- Privacy concerns: the Office of the Australian Information Commissioner (OAIC) — oaic.gov.au; - General consumer concerns: the ACCC / your state consumer affairs body (Fair Trading NSW etc); - Payment disputes: your card issuer's chargeback process, subject to Stripe's dispute rules.
NestWise is deliberately outside the AFSL regime and is not a member of AFCA (the Australian Financial Complaints Authority) because we do not provide financial services within the meaning of the Corporations Act 2001.
16. Suspension and termination
Either of us can end this agreement at any time. You end it by cancelling your subscription and, if you wish, deleting your account. We end it by giving written notice to the email on your account.
We may suspend or terminate your access without prior notice if: (a) you materially breach these terms; (b) your use of the service causes risk of legal liability, security exposure, or significant operational disruption; (c) we are compelled to do so by law or a regulator; (d) we cease to operate the service (in which case we will give at least 30 days notice and offer a pro-rata refund of any paid-in-advance subscription).
Termination does not affect any right or remedy either party has accrued before termination.
17. Changes to these terms
We may change these terms from time to time. When we do, we will:
- Update the "Version" number and "Effective" date at the foot of this page; - Post a notice inside the app (typically a banner on your dashboard) for at least 14 days before the change takes effect; - For material changes (pricing, refunds, licence scope, dispute clauses), email you at the address on your account at least 30 days before the change takes effect.
Continuing to use the service after the effective date confirms your acceptance of the changed terms. If you do not accept, cancel before the effective date. Prior versions of these terms remain available on request.
18. Governing law
These terms are governed by the laws of New South Wales, Australia. You and NestWise submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute that cannot be resolved through the complaints process in section 15.
19. General
If any part of these terms is found to be unenforceable, the rest continue to apply. Our failure to enforce a right on one occasion does not waive that right for the future. You may not transfer your rights or obligations under these terms without our written consent. We may transfer our rights and obligations (for example, in a corporate restructure or acquisition) provided your rights are not materially reduced.
These terms plus the Privacy & Data Safety policy are the complete agreement between you and NestWise about the service. They supersede any prior discussions, marketing statements, or communications.
Privacy & Data Safety
